No, it's not MY opinion. It is, actually, a fact. State has the burden of proof, a defendant can refuse to testify and self incriminate himself ...it happens all the time.

I could see making that argument if he is driving on a suspended license for having multiple traffic violations or a DUI but for simply not having a license yet, that wouldn't have an impact on me. Plus, if he had been pulled over and not had a license I assume that would have been on his record and brought up in this case which points to him not driving recklessly or illegally even without a license.

I think the infuriation we viewers are feeling will certainly be felt by the jury members.
