John Edwards was tried, but the payment on his behalf was made about 10 months before an election. This one though all happened weeks prior to an election and the new stories about Cohen's decision to do this after the Access Hollywood Tape would look bad to a jury.

Right and right. My point is that these kinds of cases can and do go to trial. The Edwards' prosecution had a hard time proving that the payoffs were meant to influence an election and not just to keep it out of the press, away from his wife, etc.
