I’m not sure that the fact that this pardon gets yours and Barack’s panties in a collective knot qualifies as one of those factors.

Every pardon ever by a president has used the Constitution. As far as I'm aware, none have ever been overturned. So, yep.

What I'm saying is, there's really no such thing. There are some bureaucratic guidelines, but the Constitution remains the governing authority for this.

For most of them, yes. The President has the power to bypass that process, but it wasn't done very often.

Pardon power of a president is about as absolute as anything that exists in our form of government. It's essentially NEVER been successfully challenged.

When the FBI opened its investigation into the Marc Rich pardon it cited the failure to follow DOJ rules and regulations as part of the justification.
