Also does a house you do not have an occupancy certificate count as a dwelling? The house was under construction.

To me, it looks like the dad had to reach down to get his gun which occurred after the initial shot

They wouldn’t be justified in shooting him just because he started to fight. They would need to show that they reasonably feared that they faced an imminent threat of danger of losing their life or serious bodily injury from victim of the shooting.

He had just been spotted inside a house under construction, sounds like he was stealing equipment from the contractor and had done it before

Except the owner of the house reported the footage only showed him trespassing, not stealing. LINK
quote:

The owner of the under-construction home, who is listed as a victim in the police incident report, said his surveillance system captured at least four short clips of a man who appeared to be Arbery "coming onto his property" February 23. He declined to share them with CNN and spoke on the condition of anonymity because he says he's been receiving death threats.

The man walked by the garage and down to a dock on the Little Satilla River, the motion-triggered cameras show, according to the homeowner. Asked whether they showed the man stealing or committing any other crime, he said they show him "trespassing."

And if he had been stealing, where are the stolen items? None of the documentation mentions anything about any of the stolen goods being found.

Case over.

Not necessarily, the men would also have had to have witnessed the theft directly.

the problem with that call is

1. 911 was called. they should have let the cops arrest him

2. the guy can't articulate what he was doing wrong in that specific incident. all he could say is he's been caught on camera before

#2 has to be A LOT stronger for the 2 shooters to justify the citizen's arrest. saying you heard from somebody else that a black man was on a property isn't likely to be enough

Why is the main picture being shown of the guy his high school senior portrait? He’s 25. Seems weird to use a 7 year old picture.

They said on the news this morning he was 26. Not that it matters.

At first I thought he was a high school kid because they were interviewing his HS coach about what a good kid he was.

It's weird that they would keep referring to a 26 year old as a kid.

He’s not charging right at it. He even slows up when he’s coming up to the truck, starts towards the drivers side and then switches and runs around the passengers side at which point the son has exited the vehicle to intercept him with a shotgun.

All acts of someone who is guilty that just committed a crime. He CHARGES at the dad with the shotgun and tries to take it from him.

If this kid was just "jogging' in the neighborhood, common sense says he would've stopped totally or ran a different direction because he was scared shitless.

This dude was pissed he had just gotten caught, ran around the other side of the truck and makes a move for the gun.

True, but losing possession of the shotgun fits that bill.

But to even attempt a citizens arrest they needed to have seen commit a felony.

On February 27th, the police chief for Glynn county was suspended pending an investigation on an unrelated matter.

On the 28th, he and three other officers were indicted on charges relating to one of them having sex with a CI.

quote:

The grand jury found sufficient evidence to justify 20 charges, including violation of oath, attempt to commit a felony, influencing a witness, perjury and making false statements to the Georgia Bureau of Investigation.

SOP for the media in cases like this to gain as much sympathy as possible, whether shooting is justified or not

He did. He was boxed in by the person filming and the dad and his son.

This is reaching. If I was jogging and saw a parked truck I wouldn't have given it much thought.

By the time the altercation started the jogger had seconds to process everything and make a decision. You're being a monday morning couch QB.

it's not likely this strict, but they would have to have a lot more information that THIS guy was the one who committed a crime

since the people with more knowledge can't really articulate an actual crime (and certainly no felonies), it's going to be hard for the shooters (as 2nd or 3rd hand information receivers) to show this level of knowledge

you don't get to stop a random black guy b/c your neighbor saw a black guy on camera possibly not committing any crimes

By “sounds like” you mean you’re assuming. As there’s absolutely no evidence he was stealing equipment and none that he had done it before. Which is why we don’t allow citizen’s arrests based on assumptions.

It’s the same playbook they used with Trevón Martin.

They are doing it to appeal to certain people's emotions.
