The only way they could have gotten the arrest was through grand jury, which means there are juries willing to disagree with you and put him away. More likely than judges.
That said, a judge *could* throw a jury ruling out but that would look really, really bad.

DOJ must have evidence he was protesting (not reporting), or maybe something with trespassing in a church where the media doesn’t have a “right” to cover if they aren’t invited.

If the Trump Administration based their actions on not wanting to receive negative press, they would never do anything.
