Is US Soccer not going to atleast let us know Berhalter is not coming back?

They are probably still trying to figure out how to get rid of him without him suing them for wrongful termination?

Yep, which is why they aren't going to say he's not coming back until they make a hire.
They've been very careful with their verbiage in saying publicly he is still in the running amidst this, so that when they ultimately do hire someone else, they'll be able to say that the investigation had nothing to do with not hiring him because we have receipts that say we were still considering him even while the investigation was going on.
I can say with a million percent confidence that he will not be the head coach.

The lawsuit wouldn't be for firing him, it would be that he would have otherwise been considered if not for the investigation.
