SS Disability

Brother in law, age 61, has been given a cancer diagnosis that will require him to take radiation and chemotherapy for 7 weeks. Has it in his lymph nodes so the outlook is pretty grim. Can he apply for SS Disability? He lives in Texas and has been a truck driver.

Mom had it around stomach and it spread to lymph nodes. They removed all they could see, 6 months chemo and now free and clear with an 80% chance it never comes back.

Not positive but pretty sure you have to be expected to be disabled from working for at least a year to qualify....but may be an exception for a likely terminal death diagnoses.
No doubt there are tons of SS Disability lawyers in Texas who will give him a free telephone consult from anywhere in the state. You don;t have to hire one locally. Disability lawyers typically take cases all over the state since most everything is done on paper work or remote video testimony hearings these days.

Seeing how slow and inefficient the SS is, he will likely be done with the treatments by the time the SS gets all the necessary documents from the doctors and makes a decision to approve or deny

His Dr has to write a letter explaining why he is unable to work.
It’s a pretty common practice, tell him to discuss it with his physicians office.

Good news if he is approved they will back date to the date of application.

He has to be disabled for a year or longer to qualify for SSDI. He may be able to qualify for Short Term Disability if he has a policy but I doubt he would even qualify for that. I am guessing he doesn't have a Cancer plan through Aflac, Colonial, or one of the other Voluntary Insurance companies because it's situations like your Brother-in-Law's are what those plans are designed for. Does he have a life insurance policy with an excellerated benefits rider for Critical, Chronic or Terminal Illness or any permanent life polcy with cash value? How soon will he be 62?
