If it's not spelled out in your judgment, it goes to whoever has the kid the majority of nights in a given year.

You need to get the custodial parent to fill out Form 8332 (regardless of what is in a divorce decree, this form supersedes any legal agreement in the eyes of the IRS). Then you have to meet all the normal requirements of the CTC.

Communicate with the custodial parent on how to proceed. If nothing in legal documents, either alternate years or split the credit ($1100 each parent) and have the parent with best tax situation claim.
