First time DWI and a clean record and he could prob work out a deal himself with the DA.
The only way to beat a DWI is if there is faulty evidence or it’s a bad stop.
Within 30 min of refusing to blow a judge will have signed a blood draw warrant, plus, refusal can be held against you at your trial

I did this about 15 years ago. Cost me about $7k all said and done, but I dont regret it..the attorney and $. I do regret being a dumbass.

Which you can appeal to an admin judge. When you lose that admin hearing, you can then appeal to a judge judge. Before that hearing, you can ask the State to agree to hold the appeal in abeyance pending the resolution of the criminal matter. They frequently will. While the appeal is pending, the suspension is also… suspended.

It’s pretty easy for a sober cop to gather evidence on a drunk driver. Drunks slur speech, usually smell like alcohol and eyes water/red. All these observations go into the DWi report. The field sobriety horizontally gaze nystagmus eye test is pretty much fool proof.

In BR - You don’t need a lawyer if you 894. 894 is basically “getting off”, but if you ever get another one, it will still count as a second offense. So it’s not really gone.
If you go the route of pre-trial diversion and go through the myriad of programs they make you do for that, a lawyer is helpful. And it makes a future DUI a first offense because it’s like it never happened after X amount of time.
I did the latter and it was $10k all said and done between fines, classes, breathalyzer in my car, and lawyer. This was in 2011 when I was 21 and stupid.

That's what my dad's lawyer did when he got his dui. Kept filing to change time/date/location of hearings until the cop didn't show up.
My dad paid several thousand dollars for that, but it was still cheaper than it would have been.

I detest drunk driving but also understand you have to earn a living. Its' not like hiring a lawyer is an automatic dismissal. It's more likely to be a very expensive process to have some sort of lesser charge or diversion program in order to keep it off the record.
You would think someone would learn their lesson from getting a DUI knocked down with a lawyer and sober up, but that's not how alcoholism works. It's an addiction.

Demand a blood alcohol test instead of the blow. I don't know if it will help. A lawyer may help if there are certain hardships involved. Maybe with the fine but you are going to lose the permit pretty much for sure.

If you ARE NOT intoxicated, blowing will help you NOT get charged with DWI. (Your BAT may indeed be LESS than the legal limit.) If you don't blow, you'll have to take your chances with the officer testifying about how your eyes were bloodshot, how you slurred when you spoke, and how poorly you did on field sobriety tests. Your license will also be suspended.
If you ARE intoxicated, then damn you for driving drunk. You deserve the DWI conviction. You are no hero for thinking up ways to avoid accountability.
