The fake electors thing is such a bullshite accusation. The idea was not new and did not originate with Trump. JFK actually assembled a group of "fake electors" in Hawaii during the 1960 election. Was he prosecuted?

Also want to add that several states have refused to prosecute the "fake electors" because it simply does not violate the law.

Here is what the Democrat AG of Wisconsin said:

I know I'm preaching to the choir, but I've seen settlements of convenience in the med-mal world WAAAAY too often.

A completely innocent client is confronted with a sure-thing settlement vs a bullshite case presented to a clueless jury of peers who might, in their abject ignorance, find for the prosecution.

In this case, there's only a 1-in-5 chance, but if they find for the prosecution, you're going to jail for the rest of your life ....

.... and oh .... by the way, they have an unlimited budget,

so your defense will cost ... well ... a lot.

Do you have that kind of cash to piss away, or do you want to preserve your resources and settle for no jailtime?

A nation-ending blowback like we have never seen will occur if they try to throw Trump in a cell. I don't think you fully comprehend the gravity of such an action, nor do you appear to have the mental capacity to fathom exactly how divided and hostile this nation will become at the drop of a hat if this happens. We're already in a cold civil war and it wouldn't take much for shite to rapidly go very hot.

You will do nothing but continue to post on message boards. Americans are much too fat and lazy to do anything else. They saw what happened to Jan 6 protesters. They ain’t gonna waste their comfortable lives to go to bat for a man who left his supporters out to dry.

I never said anything about anyone else's mindset and intent. Cheseboro authored the memo outlining the whole fake elector scheme and the plan to delay the counting of electoral votes. His mindset and belief in all of this is highly relevant to Trump.

But since you keep asking everyone, Trump is charged with:

At least 3 counts of SOLICITATION OF VIOLATION OF OATH BY PUBLIC OFFICER. OGCA 16-4-7 makes it a felony to solicit, request, command or otherwise attempt to cause another person to engage in conduct constituting a feloney. OGCA 16-10-1 makes it a felony for any public officer to willfully and intentionally violate their oath of office.

Trump is accused of this violation by attempting to coerce speaker David Ralston to call a special session for the purpose of appointing presidential electors in violation of Georgia law. Also for the Jan. 2 phone call to Raffensperger seeking to have him decertify the election, and his request on September 17th, 2021 to Raffensperter to "decertify the Election, or whatever the correct legal remedy is, and announce the true winner"

Multiple counts of the offense of MAKING FALSE STATEMENTS AND WRITINGS. OGCA 16-10-20 makes it a felony to knowingly make a false statement or use a false writing or document in any matter within the jurisdiction of a public agency.

He is accused of knowingly making false statements to Raffensperger, and in the fake elector scheme. Trump's state of mind might be hard to prove, but there are multiple emails from Eastman prior to the Raffensperger phone call telling Trump the claims were wrong.

For the fake elector scheme, I'm not clear on what he allegedly said to whom.

He is also accused of conspiracy to commit Forgery, Conspiracy to commit impersonating a public officer, Conspiracy to commit false writings and documents, Conspiracy to commit filing of false writings and documents, all related to the fake elector scheme. I do not know his level of involvement in all of that, and I think that is more likely to be a problem for Trump in the RICO charge.

His also charged with FILING FALSE DOCUMENTS in violation of OGCA 16-10-20.1(b)(1)...but that is for making false statements in the verified complaint filed in Federal District Court on December 31, 2020. That seems like something the Federal Court should address, not a State court criminal charge. Besides, I think that complaint was voluntarily withdrawn, although its hard to keep track.

Of course, the ultimate charge is the RICO violation, and honestly Georgia's RICO charge is so broad and vague that it seems unconstitutional. It has survived challenges so far, though.
