Thanks for the brain-teaser - I may repeat it to others who discuss this acute matter.

All I know is - Biden will NOT be on the ballot - I have had this firmly in my mind as the ONLY logical explanation for the actions of the Democrat party for the past 4 years.

Democrat big-wigs are evil - but they are not stupid - they will NOT go into this next election with Biden as their vote-getter.

And if they do - it only means one thing - they have the RESULTs of that election already arranged and there will be nothing anyone can do to stop it.

He won't go to jail, anyway, IMO.

My suggestion is that he might give Hunter a blanket pardon in order to stop the investigation into Hunter, and by extension, Joe.

I don't know if that is even possible.

Correct Bard, it is funny though, that he ended up in this trial because his lawyers, in collusion with the DOJ tried to do just that, they filed papers for the gun charge to be a misdemeanor and put a clause in there that he would be immune from any other prosecution of any type that was found in the future.

The judge laughed and asked them if they didnt think he would read the whole thing. Then asked the DOJ if THEY HAD EVER agreed to such a thing in the history of the dept, then said nope we are going to trial.

A little of both, but mostly the latter. A President can't pardon for state crimes nor civil crimes (can't find the case law at the moment), for example.

For those within the pardon's realm, the real problem with this is determining standing. A couple others have brought up Nixon and that's a great example.

Ford pardoned Nixon for any (specifically unnamed) crimes he may have committed, but who would have standing to challenge that? Congress? They didn't try so the question is unanswered.

Were Joe to try to pardon Hunter before there is a conviction, we might get the answer to that question.

I have a problem with the ability to pardon before there is a conviction because that essentially gives a President (or a Governor, depending on the state's laws, I guess) a dangerous amount of power in blocking the machinery of justice.

To be honest, anyone who cares about the Second Amendment should hope that Hunter is not convicted of the gun charges. They're a violation of his Constitutionally protected rights.

There's a few hundred other things that he could easily be charged with, so why do they only focus on the firearm "offenses"? That's rhetorical.
