Why should you receive a windfall because you got into an accident?
I would say I don't view it as a windfall. I think that's probably the difference in view points on this issue
If you receive compensation that exceeds your actual damages, what would you call that?

Can you give a list of the HB/SB #'s associated with each?
I have found quite a few of them but wanted to read the bills.
Thanks

Here's the Senate ones
--SB108 change in recoverable write off amount to 30%--amount billed/paid discoverable before trial. Also gets rid of presumption related to causation
--SB 150 similar to SB108/34--relate to recoverable medical specials
--SB 209 another one regarding recoverable medical specials
--SB 231 another one regarding recoverable medical specials.
Lots of interest in recoverable medical specials. lol

So, Jay Luneau's response to rising insurance costs is to pass laws saying they can't rise!
quote:
Louisiana's 2025 legislative session kicks off this coming Monday and I'm raring to go!
I have pre-filed seven bills, including SB62, which gives the Insurance Commissioner the authority to determine when rates are too high or otherwise excessive.
The bill bans insurers from proposing rates that are excessive, inadequate, or unfairly discriminatory, regardless of whether the market for a particular line of insurance is deemed competitive.
Posted on 4/10/25 at 2:51 pm to AlxTgr
Yet "the authority to determine" is undefined in the bill !!!
Needless to say, the Insurance Commissioner doesn't support this bill.
This legislator thinks we should just go back to whatever King George III tells us peasants to do.

Until such time as someone not beholden to the trial lawyers is elected governor, this state will NEVER have a sane tort litigation system.
Period.
Period.

No real tort reform because the clueless voted for the YEEHAW candidate for governor bankrolled by trial lawyers.

Instead of continuing to throw darts at a board every 5 years, why don’t the insurance carriers just show their math on how they calculate premiums and we can target legislation towards the areas that are increasing premiums at a higher rate?

Get the hell out of here with rational ideas!

One thing I know is that if my homeowners insurance keeps going up 30%-70% every year I’ll have to sell my house. We must stop the bleeding there.
