Kelly deserves his pension for his service. He put in the time.
Well, that depends, doesn't it?

If someone is guilty of making seditious statements it doesn't matter how much time they put in, I would think they could be stripped of benefits they otherwise would retain in good standing. I doubt you retain your pension if you are court marshaled, for example, even of you have 50 years in.

On the other hand, if the court rules that the statements don't rise to the level of sedition, then Hegseth is guilty of textbook retaliation violations of the 1st Amendment.

So the amount of time Kelly has in is not the factor. Whether those remarks are considered seditious is the operative factor.
Entirely reasonable analysis.

So you will be downvoted into oblivion.

Now THIS will be a fun lawsuit.

It will be a short one. This process is pursuant to the UCMJ. This court has zero jurisdiction.

Thanks.

I personally think "downvoting" is about the gayest thing that is still allowed in public and I'm always amazed grown men do it.

But they do. All day every day, here on the TD.

Good. Discovery maybe’s up being a bitch for Kelly. How far into his finances can the respondents dig?

Agreed. Kelly deserves his pension for his service. He put in the time.

I'm not sure how you agree with me then say Kelly deserves his pension. He understood the rules quite well and broke them in hopes of political capital, which the rules are specifically designed to prevent. The military is supposed to be strongly apolitical.

Mark Kelly is a fricking twat. He's the type of guy that has Douglas Niedermyer as his hero. An arse kissing politician that probably aggravated the heck out of guys who served with him.

Zero.

His personal finances are not (and will not be) a valid issue in the lawsuit.

Since Kelly’s treason was coordinated with other enemy of the free American Republic Democrats, information will be gathered as to whom is coordinating and funding this treason.

BTW, Hegseth was way too easy on Kelly. This was an act of treason.
