Article 1 Section 8 of the Constitution:

The Congress shall have power to lay and collect taxes, duties, imposts and excises, to pay the debts and provide for the common defense and general welfare of the United States; but all duties, imposts and excises shall be uniform throughout the United States;

Congress, not POTUS

That sucks….so basically it’s ok for other countries to rape us tariff wise but we cannot use tariffs to reciprocate and be used as negotiating measures without our useless congress’ direction….is that right?

Yeah, I suspect there is a shite ton of nuance in the ruling that Trump can work around.

Nuance isn't needed

There are statutes the admin could clearly use. The question is why they took this risky route with aggressive interpretation when there are multiple options that would clearly grant the admin the authority

Well, at least the TDS'ers are happy. A rare but potentially big win for them.

It makes complete sense to anyone that was following this, including the Trump admin that almost certainly knew how flimsy their justification was under the particular statute they used.

They also know now that they can likely just use a different statute to start all over again.

I would like to see the actual wording of the ruling though
