Everyone needs politics to be a drama series these days.

I mean the whole thing is being run as if it were a reality tv show so it makes sense that people who didn't use to take part in the process would now view it through that lens

Yea. I bet clarifying this legal issue was the goal all along. Because spending a quarter of the term on that endeavor is good strategy that accomplished a lot?

Imagine that you were the owner of a business that closed down directly due to tariffs? Or an employee? This has to sting.

I think most people would be fine with tariffs that are fair, well researched and make sense. But what most people don’t like is how Trump would wake up on the wrong side of the bed and just make up tariffs as he went along. None of it made any sense other than just political pressure on countries.

I never understood how this didn’t have to go through Congress.

Man, yall are strange. No one cares that much

But pretty much all of us that have some legal background, even those of us like myself that are very right leaning, said it was questionable at best that this act would work.

I understand why people would be in favor of Trump just acting and attempting to expand exec power

People of sick of Congress doing fricking nothing at all, especially when Rs are in place. And Trump just does things. He acts

But what happens when you get the Dem Trump and a Dem Congress...

Much like businesses that shut down from COVID regulations, a necessary evil. At least Walmart and Amazon could absorb their customer base though!

The President's argument is that Congress gave the power to tariff to the Executive under certain conditions. Not that the President has the power to tariff without Congressional approval.
Aye. But the president made several mistakes. First, we aren't at war. There is clear intent that the powers were delegated for wartime. Similarly, "Neeneer neeneer they did it first" retalitory tariffs aren't an emergency. Second, the president didn't tariff selectively. He tried to tariff almost all countries. Too broad. Third, he kept changing the tariffs almost daily at some points. That indicates an exercise of capricous power, not trying to solve an emergecy.

As usual with SCOTUS it's worth reading the opion itself LINK rather than relying on what polical tard influencers say about it.

That said... this part sounds familiar....

quote:

The President asserts the extraordinary power to unilat-
erally impose tariffs of unlimited amount, duration, and
scope. In light of the breadth, history, and constitutional
context of that asserted authority, he must identify clear
congressional authorization to exercise it.

IEEPA’s grant of authority to “regulate . . . importation”
falls short. IEEPA contains no reference to tariffs or duties.
The Government points to no statute in which Congress
used the word “regulate” to authorize taxation.
