“If you are seeking redress under the equal protection clause do you need to know what a man and a woman is?”

“And what is the definition of a woman?”
“You would have to understand what they meant when they used those terms to figure out whether someone was excluded.”

“We don’t have a definition for the Court. We’re not taking issue with the definition we’re saying it excludes people in the way it is applied and there’s a subset of birthed males where it doesn’t make sense to do so in the state’s interest.”
“How can a court determine whether there is discrimination on the basis of sex without knowing what sex is?
“Um…I think…I think here we just… we just basically know that they are defined by the statute as a birth sex male and are being excluded by the statute.”
What I think you are going to see here is the Court refusing to strike down statutes banning men in women’s sports. In response, legislators in blue states will write statutes that fundamentally redefine what is a man and what is a woman. That is, they will codify into law that a transgender woman is in fact a woman. So I think you will see men in women’s sports in blue states and men not in women’s sports in red states.

Title IX was written in 1972. at the time it was written it was to protect women as defined in 1972.
If Title IX needs to include Men now calling themselves women, then Congress needs to rewrite Title IX accordingly........

This is the hopium of leftist progressives.
It will be a bloodbath for them if that’s the case though. I would LOVE for that to be on the ballot for 2026 and 2028.

Same dilemma that popped up in England. There has to be a definition otherwise how can a determination be reached. And of course the only means of determining is biological reality.
