So, I have cousins that were / are cops. They said back 35 years ago to NEVER agree to a roadside test even if sober......and especially don't do it late at night after 11 -1130 pm. The whole process is designed to get you. Cops are trained to show up at a certain distance with their brights on and their blues and reds flashing. It can disorient even 100% sober folks. Breathalyzers used to have to be recalibrated after 1 night's use.
Why people don't challenge the tests in court more is beyond me. Both roadside follow the finger, walk the line.,etc and the breathalyzer.

I rarely drink but due to some brain issues I have upward vertical nystagmus and downward vertical nystagmus. I would flunk a field sobriety test. But, if I was ever arrested, I would immediately get out and go get a blood test.

Agree. It's subjective at best.
In my state, the roadside breathalyzer test is voluntary and also not admissible in court.
So based on this, I understand that it's best to refuse both and then consent to the official evidentiary breath, blood, or urine tests administered after you're arrested. (Obligatory "not a lawyer," but it's something about implied consent due to choosing to drive in this state. Those tests are mandatory.)
Which is all good stuff to know.
*But you really just shouldn't drink and drive. Not worth the risk.

Issue is in Louisiana you lose your license for a year or two if you refuse the test.

This happened to my dad(RIP). Was driving home after having 2 or 3 Mich Lites and got pulled over and was administered the test. He passed. The cop was pissed.

It's a racket. The county makes thousands off of each person's pretrial program and its an easy, repetitive paycheck for lawyers.

Looking at you Monroe. Especially the frick who ran me through a sobriety test and after the follow the light bullshite started taunting me saying get ready to go downtown you're not doing so good...at one point when my wife then gf tried to question him he straight yelled at her and said get ready to pick him up in the morning...
Problem is I had had ONE beer that night at the Monroe mardi gras parade that's all of 10 minutes long. I proceeded to lift my leg and count then perfectly walk a straight line.
Cocksucker knew I was fine. I was even in my neighborhood so he "LET ME" park my car there then walk home.

I’ll happily take a breathalyzer, but the field tests are garbage.
Say the alphabet in reverse on one leg while cars drive by at 50mph and I shine my flashlight in your eyes at night.
No thanks. It’s like a loaded question from your wife when she’s had a few drinks and is in a bad mood or the old line from “War Games”… the only way to win is not to play at all.

There is no Pass or Fail.... its all subject to interpretation by someone that will never be held accountable and is rewarded for making DUI arrests.
FSTs are designed to create evidence to support charges.... not to prove innocence.

Never help them with their investigation. Police officers are not your friends.
I would hate to refuse a breathalyzer in Louisiana though. The dmv is so fricked up. Even if the court dismisses you of any wrong doing I will guarantee that the dmv will still screw up your license.
I’m dealing with them right now on my last dwi and it’s a mess. The state is completely inept.

My lawyer buddy always reminds me the battle is in court, not on the side of Hwy 6. Never blow the straw or stumble the pavement. Keep your mouth shut, go to jail for the night, surrender the license for the time, bond out, and live to fight in court.

Just say “no” to every thing they ask - including answering any questions or requesting permission to search your vehicle. Finish it up with “not without my attorney present.”
You’re going to get processed and you’re going to lose your license - but most criminal defense attorneys are handy at beating DUIs…and you don’t want it going on “your permanent record.”

Agree, never consent to a field sobriety test or basically anything in the field including the breathalyzer. Don’t give them any ammo to use against you because that is all they are doing. You can agree if you are stone cold sober but if the cop is intent on giving you a DWI you are probably getting arrested anyway.
I will say losing your license even if you don’t get the DWI is pretty damn bad. Most employers do DMV checks on prospective/actual employees and that license suspension is a gigantic red flag.
