True. I used the vernacular term.
"Vernacular" doesn't mean "wrong".

Please enlighten me. This should be entertaining.
In what legal or casual use of the word does murder includes self defense?

I haven't seen this published anywhere. Has anyone seen this from an official report?

Wow, read the first two pages and saw a poster completely misstate Wisconsin law and then try other invalid arguments/facts/suppositions.
Amazes me at the ignorance of a few on this board. Surprisingly, all support untenable positions yet keep posting and flaming. Facts do not matter to them.

Wisconsin law?
Look, I get accused of being pedantic, and sometimes it is even true, but the way an affirnative defense works is that the jury gets two questions. First, did the defendant commit the offense. (e.g. did he kill someone). Second, was that act justified? (e.g. self-defense)
You can commit the elements of the offense (as young Kyle clearly did) and STILL not be convicted because your actions ALSO meet the elements of being justified.
That is what will happen here.

No, you get accused of being an absolute moron. And it’s always true.

quote:You are babbling. My first post said that his actions were legally justified.
No smart arse, it was not a MURDER. You claim to be a fricking lawyer. You ever hear the term justifiable MURDER? Hint: you haven’t.
quote:It is clear that many if you do not understand the applicable terminology. No crime in that. You are laypersons. The entertaining part is watching you attack someone who DOES understand it.
That murder is ALMOST CERTAINLY justified, and he will ALMOST CERTAINLY not be convicted, but that is a question for the jury.
Posted on 9/14/20 at 9:30 pm to AggieHank86
Wrong again. They will not be asked if he committed MURDER. They will be asked to determine the facts and weather the facts support a finding of guilty for a particular charge.

You clearly don’t understand shite. Otherwise you wouldn’t have said he committed a MURDER. Watching you try to explain your way out of this shite is fun though.

From the retard that doesn’t know the definition of murder and claims he’s pedantic

quote:There was a lot of speculation about him. The consensus was that he was on some sort of conditional release, and I opined that an MTR was likely in process if that were the case.
So why is the guy who was shot in the arm after threatening Kyle not arrested?
Now, it appears that he HAD been on a conditional release, that his conditional release term was completed some years ago and that the associated restrictions on firearm possession may have expired by the terms of his plea deal. From what I have seen, the answer to that question is not clear ... one way or the other.
If the restrictions DID expire, there is nothing TO revoke. In that instance, it is legitimate to ask whether his actions with that weapon that night violated the more-general Wisconsin gun laws. Perhaps so. A reasonable person could certainly believe that he was threatening young Kyle with that handgun.
It is hard to answer these questions because there has not been much legit reporting on him or on his earlier legal ... difficulties.

quote:Why are you so wrapped-around the axle about this? Different states use different terminology, but the concept is pretty-much universal. In Texas, self-defense is defined as a ”justification” which excuses criminal responsibility.
Justified murder
