I think the root of the problem is that you think immoral people would recognize property rights. It will never happen.
You can call it what you want, but "morals" or social mores, are the guiding principals which have made this country great and without them we are all eating shite sandwiches.

They tangle well before that. People don't notice it because there's such widespread agreement over "don't have an orgy on the public playground", but that's legislating moral behavior and limiting freedom. You can go to the park, you can play flag football, you can even wear a bikini. But at some point we say "ok, that's enough" and we draw a line that regulates behavior and it is 100% based on subjective moral values.
The argument isn't whether or not to draw a line, it's where the line gets drawn.
