How long before the car started forward was the engine reved up? Remember that the tires spun at first. But the officer was standing two or three feet away from the engine. My guess is that when she punched it he drew his gun. Then the tires spun and it started moving forward.

Yet when Agent Fife chose to unload into her vehicle rather than letting her just drive away, ONE person died.

This is obviously true, in spite of your downvotes, but I think you are wrong about the outcome. He was standing in front of the car when she hit the gas. Video evidence shows that she knew he was in harm’s way. He can probably prove that he only drew his weapon when he heard the engine rev up.

He will almost certainly not be convicted for the first shot he fired. I think his problem comes from the third shot he fired. He’s going to have to convince a jury that the third shot followed so fast upon the first that he was powerless to correct his course. Advocates for the agent are going to say that in the heat of the moment his three shots were one continuous action. And that’s plausible, but it’s what the jury thinks that matters.

This might come down to a forensic analysis of which shot killed her. If it was the first he can’t be convicted of murder. If it was the third he might be going to jail. The second? Probably he’s okay?

LEO are trained when discharging a weapon to shoot until threat is neutralized....that's why most shootings are 3 shot minimum. Usually, they unload the magazine.
