Was posted earlier. Only 5 times since 1776 has Congress Declared war. Over 400 times has the US Military “intervened”.

1942? I could have sworn the Day of Infamy was December 7, 1941 with declarations of war against Japan and Germany within the week.

June 1942 Hungary, Romania and some other countries, I believe.

Don’t know why someone downvoted your statement but 2001 ain’t anywhere close to the first time a President used military for extensive action without Congressional approval. Doesn’t make it right or wrong now or then, necessarily.

Best I can tell the WPR has never been ruled on by SCOTUS.

Looks like it made it to court once but Clinton ended the military action and either mooted it or the direct court found it to be a non-justifiable political question.

Federalist 41 looks to be the most on point regarding the breakdown between Congress and the executive

Also the Hillary lead from behind Libya operation wasn't considered a war action because we flew under the auspices of NATO.

Therefore the 60 day clock etc didn't apply. So said Barack the Benevolent.

Do some reading on it. It is clear as mud how those powers are really delineated, and no one involved is in agreement.

I took a class in law school from one of the sponsors of the WPR, Senator Spong. He thought Congress didn't have the power to delegate its war powers, but he viewed it as the only practical way to constrain the Imperial Presidency.
