Until the pardon is "official" it is not a basis for a dismissal. There are formalities required. A press release doesn't do it.

So if he wasn't ever charged how can he get a pardon?

He was and he also pleaded guilty in court.

Smoke and mirrors, this was pre-arranged bs to give the doj cover.
Remember the fbi that hid the laptop works under the doj.

I think so. This is all posturing to make themselves look better and credible. Their credibility is already wrecked. It’s a PR move.

Let Trump pardon Hunter along with the Jan 6ers and then tell Dems he was able to get things done that Biden can’t.

I agree. This is fake fighting to act like the machine is still being tough on the Biden family.

The conviction was fraudulent because the special counsel was appointed illegally anyway

Could this be about making sure 1/6 convicts keep their conviction record in case of a future Trump pardon? Genuinely asking.

I don't think they are related in any way or that a pardon wouldn't fix the J6ers' issues

I would love to see Hunter behind bars, but how is that pardon "constitutionally dubious?"

Yep someone trying to get on Trunps good side
Or a Trump hater with an axe to grind against Biden for not stepping aside before the Dem primary so they could nominate who appealed to voters instead of being stuck with Kamala after it was too late to change.

Trying to use this as a means to take away trumps potential pardons….

How wouldn’t a pardon “fix” their issues? A pardon can come after conviction and after serving sentence.

Pardons (and commutations) are an act of forgiveness, not erasure. Expungements are the legal mechanism to wipe away someone's criminal record but they are usually only applied to dismissals and very rarely to cases where a defendant has pled guilty or been convicted absent special circumstances (like a witness admits they made the charges up).

Expungements are granted very frequently in fact even when a defendant has entered a plea of guilty.

But if I'm reading this correctly, it sounds to me like the special council is making a fight to keep this on Hunter's legal record. Rather than to have the charges against him dismissed.

That’s what I got out of it as well. Particularly that he pled guilty.

I would think this matters if he were to ever get charged again for similar crimes.

That's a really good point!

On a side note, the gun charges were a violation of Hunter's Second Amendment protections,

Yeah, this was a big test on a lot of us in the 2a communities. We really want to see the Bidens go down. While at the same time absolutely hating it, that there was a marginal chance (we all knew Biden would pardon him, and the falsification charges wouldn't go to a higher court) of a 2a win in SCOTUS from a shite bag Biden.

i think someone needs to legally challenge the idea of pardoning someone for crimes they have not even been charged with yet over a broad span of time

I read about the pardon going back so far. And so I did some research on if a presidential pardon could be overturned.
What I found was NOT good news.

I was looking for any little chink in it that I could find.
I wish there was a way to fight it. I really wish there was some way.
But unfortunately for us, right now, the only way to overturn a presidential pardon is if the president doesn't deliver the pardon.
And we can be darn sure that Biden will deliver it.
