The decision by a three-judge panel of the 9th U.S. Circuit Court of Appeals upheld a lower court ruling that found she exceeded her authority when she ended temporary protected status (TPS) for Venezuelans under the Biden-era Venezuela TPS designations, according to The Associated Press.
All three judges on the panel were nominated by Democratic presidents. The ruling comes as the Trump administration has argued that TPS for Venezuela created a "magnet effect" for illegal migration and undermined border enforcement. TPS shields eligible migrants from deportation and allows them to work legally in the United States while conditions in their home country are deemed unsafe.

Doesn’t count until Boasberg weighs in.

Do you understand how federal courts work? Hint: There’s another court that’s over the Ninth Circus.

9th U.S. Circuit Court of Appeals needs investigated and charged with criminal conspiracy.

Temporary doesn't mean Temporary, apparently.
Also, as I know SFP will point out the APA issue, the whole concept of this applying to immigration and national security questions is straight up retarded.
Yes, we have a group of people that were improperly given TPS status (or it was improperly extended) by executive fiat, but you by God have to check every APA box to undo it.
This will end up at the SCOTUS and could very well spell the beginning of the end of the APA.

I do. This is where the status stands now. By the way, how is Bovino’s social media?

I mean it's the law, though. Not a controversial one, either (although given some of the arguments about Executive authority made since Jan 2025 you'd think the Supreme Court has failed to realize how unconstitutional it is with many ultra-right justices authoring detailed opinions about the applicability of the law over that time).
It's one of those laws that's been applied (at the final level) pretty even-handedly in terms of partisanship.

How Scalia and Thomas didn't realize this for literal decades would be quite the explanation

Yep, too many of them and too politically aligned and partisan.
Entire Judicial Branch needs a thorough fumigation and a re-set to find those who are truly driven to serve their profession instead of politics.
Of course such an undertaking would fall to the equally broken and often inept Congress so things aren’t looking great at the moment.

I don’t disagree at all. Would you include the Supreme Court?
Maybe get rid of appointments altogether and move to elections.

these judges need to look up what that T stands for

Why do you people keep falling for federal court rulings only to have them overturned ALMOST EVERY SINGLE TIME?!
Posted on 1/30/26 at 8:48 am to LSUTANGERINE
Sometimes I think these judges just want to see their names in headlines.

Yep, USSC has a say.

I have a personal interest in this- an outstanding young man who considers me his father- who now speaks fluent English- has LEGIT temporary status- a car- car insurance- a job laying fiber cable all over America- an SS number- health insurance- never taken one penny of government assistance-goes faithfully to church- has dozens of friends-a steady girlfriend-knows The Bill of Rights and as it looks now- will likely earn his green card. I have never been prouder of anyone in my life. My pride is that of a father he never had.
I support ICE in terms of acknowledging their federal authority. And I hope they continue to remove all dangerous felons from the country. And I hope they fight insurrectionist violence with GREATER violence. And I am for the border wall and for observing the rule of law. I have also had a work Visa in another country ( Japan) and believe strongly in countries retaining their identity and STRICTLY assimilating legal immigrants prior to naturalization.
I hope everyone keeps in mind that the grey area here include a lot of truly outstanding people who fled because their families were terrorized by Maduro and their property seized and they have nowhere to go back to. I’m not suggesting anyone change their mind on anything- in fact I think you all are correct- but leave a little space in your reasoning for the amazing exceptions.

Exactly. The United States was arguing that it was so bad over there that they had to intervene.

Once again, one party can make Executive orders but the other can't. I wonder what is Different
